End user license agreement

This End User License Agreement ("Agreement") is a binding legal agreement between you and Cultivibe LLC("Cultivibe," "we," "us," or "our") regarding your use of the Cultivibe mobile application (the "Application").

BY DOWNLOADING, INSTALLING, OR USING THE APPLICATION, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THE APPLICATION.

Cultivibe LLC grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application on any Apple or Android device that you own or control, subject to the usage rules set forth in the Apple App Store Terms of Service and Google Play Terms of Service.

The Application allows users to share video, audio, and text. You are solely responsible for the content you upload. You agree that you will not post "Objectionable Content," defined as:

• Hate Speech: Content that promotes violence, incites hatred, or promotes discrimination based on race, religion, sexual orientation, or gender.
• Harassment: Bullying, stalking, or threatening other users.
• Sexually Explicit Material: Pornography or highly suggestive content.
• Illegal Acts: Content promoting illegal drug use, violence, or criminal activity.

Cultivibe LLC maintains a zero-tolerance policy regarding Objectionable Content. To ensure a safe environment:

• Filtering: We may use automated tools to filter or flag offensive content.
• Reporting: The Application provides a "Report" button on all user-posted content. Users may also report abusive accounts.
• 24-Hour Review: Cultivibe LLC will review reported content within 24 hours. If the content is found to be in violation, it will be removed, and the offending user will be blocked.
• Ejection: We reserve the right to immediately terminate or suspend any user’s access to the Application who violates these terms.

The Application and its original content (excluding UGC), features, and functionality are and will remain the exclusive property of Cultivibe LLC and its licensors.

Cultivibe LLC is solely responsible for providing any maintenance and support services for the Application. Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

Your use of the Application is subject to Cultivibe LLC’s Privacy Policy. By using the Application, you consent to the collection and use of information as outlined therein.

To the maximum extent permitted by applicable law, in no event shall Cultivibe LLC be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of or inability to use the Application.

You acknowledge and agree that Apple and Google are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple and Google will have the right to enforce this EULA against you as a third-party beneficiary thereof.
