These Terms of Service (“Terms”) constitute a legally binding agreement between you and Cultivibe LLC (“Cultivibe,” “we,” “us,” or “our”) governing your use of the Cultivibe mobile application (the “App”), our website, and our online merchandise store (collectively, the “Services”).

• Age: You must be at least 21 years old to use any and all Cultivibe goods and services. 
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. Cultivibe is not liable for unauthorized access to your account.

Cultivibe is a community for sharing. When you post video, audio, or text:

• Ownership: You retain ownership of your content.
• License to Cultivibe: By posting, you grant Cultivibe a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, and display that content across our Services and marketing channels.
• Responsibility: You represent that you own or have the necessary rights to the content you post and that it does not violate any third-party rights (copyright, trademark, or privacy).

Cultivibe is committed to maintaining a safe and positive community. To ensure this, we implement the following:

• Prohibited Content: We strictly prohibit content that is defamatory, harassing, hateful, obscene, or promotes illegal activities.
• User Reporting: The App includes built-in reporting tools. We encourage users to flag any content or accounts that violate our Community Standards.
• Our Right to Act: Cultivibe LLC reserves the right, but not the obligation, to monitor, review, and remove any User-Generated Content at our sole discretion.
• Zero Tolerance Policy: We maintain a zero-tolerance policy regarding "Objectionable Content." Users found posting such material or engaging in abusive behavior will have their accounts terminated immediately and may be permanently banned from the Services.
• Moderation Appeals: If you believe your content was removed or your account was suspended in error, you may contact us at [cultivibe@gmail.com] for a manual review.

3. Community Standards & Conduct

To maintain the "vibe," users agree not to:

• Post "not safe for work" (NSFW), hateful, or discriminatory content.
• Harass or bully other users.
• Upload viruses or malicious code.
• Use the App for unauthorized commercial solicitations (spam).

• Pricing: All prices are in USD. We reserve the right to change prices or discontinue products at any time.
• Returns/Refunds: see our [Refund policy]
• Shipping: Risk of loss and title for merchandise pass to you upon delivery to the carrier.

All original video, audio, graphics, and "Cultivibe" branding provided by us are the exclusive property of Cultivibe LLC. You may not use our trademarks or copyrighted media for commercial purposes without our express written consent.

If you believe content on our App infringes your copyright, please send a notice to our Designated Copyright Agent at: [cultivibe.gmail.com].

• CCPA Rights: California residents have specific rights regarding their data. Please see our [Privacy Policy] for details.
• Consumer Affairs: Under California Civil Code Section 1789.3, users are entitled to the following notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted at 1625 North Market Blvd., Sacramento, CA 95834.

• "As-Is" Basis: The Services and all content are provided "as is" without warranties of any kind.
• Liability Cap: To the fullest extent permitted by law, Cultivibe LLC’s total liability for any claim shall not exceed the amount you paid us in the past six months or $100 USD, whichever is greater.

These Terms are governed by the laws of the State of California. Any disputes shall be resolved through binding arbitration in California, rather than in court, except for small claims matters.

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users or the Cultivibe brand.
